The meaning of some words used in these Terms and Conditions.

1. We, us or our is a reference to SnapAdventures LLC.

2. You or your is a reference to the person to whom we are providing our services and who is required to pay for the services we provide.

3. Services means the workshops we will organize. The precise services we will be providing to you will be stated in the literature including website(s) and newsletters advertising the services offered

The Terms

1. Legally binding contract

1. A legally binding contract between you and us will come into being when you accept the offer of services from us by booking your place.

2. We suggest that before you accept the offer and book your place you read through these Terms and Conditions. If you have any questions concerning them please contact us.

3. You should keep a copy of these Terms and Conditions for your records.

2. Providing the Services

1. Our aim is to always provide you with the Services using reasonable care and skill.

2. There are certain situations or events which occur such as but not limited to adverse weather, non or poor appearance or wildlife, Acts of Nature, war, acts of terrorism, riot or civil commotion, fire, strike and government or other official intervention which are not within our reasonable control and will affect our ability to provide the services. Where this occurs, we will where possible attempt to recommence performing the services as soon as we are able to. In such circumstances there may be a delay before we can start or continue performing the services. Sometimes we might have to bring the start time for the services forward. If we are able to start or continue performing the services or bring the start time forward but you choose not to participate for any reason you will not receive any refund.

3. Expulsion from Services

You agree to act in a suitable and proper manner whilst participating in the services with particular reference to the safety and welfare of wildlife and the enjoyment of the service by other participants and their safety. Should you be in breach of this we reserve the right to expel you from the services and in those circumstances, you would not receive any refund.

4. Cancellation by us

If we cancel the services you will receive a full refund. If SnapAdventures is not able to lead the workshop for reasons of health or any other unforeseeable event then the workshop will still take place and a suitable guide replacement will be provided of the same quality and experience.

5. Cancellation by you

Once we and you enter into a binding contract you will not be able to cancel the contract. This is so that the services we are providing can continue for the benefit of other clients. In the case of workshops to Uganda / Rwanda, any money paid by you will not be refunded whereas paid as a deposit or in full payment. Booking reservations to see the gorillas is linked to your passport number, these reservations are not able to be altered.

6. Payment

1. Price provided on Website, refer to link: workshop / Booking details

2. 50% of deposit is required at the signing of this contract.

2. Full and final Payment is required by 30 day’s prior to the workshop. This is due to the demanding Gorilla reservations.

3. Payment options include: Paypal, Venmo, Zelle, Check, Cash, Money order.

7. Your details

In order for us to confirm your travel arrangements, you must provide all requested details by 60 days prior. These details include but are not limited to full name as per passport, date of birth, nationality, passport number, passport issue and expiry date and any pre-existing medical conditions you have which may affect your ability to complete your travel arrangements. Failure to provide requested details may result in non-refundable cancellation of your workshop.

8. Insurance

It is your responsibility and you are required to ensure that you have adequate travel insurance to cover all eventualities where you do not receive a refund from us.

9. Restrictions and Assumptions

We will assume that all information and facts that you provide are accurate and true such as your level of fitness and health. It is your responsibility to draw to our attention anything which may be relevant or which may affect you from participating in the services we provide before booking and making your payment to us.

10. Inclusions

The ground handling price of your workshop includes:

• All accommodation as listed in the workshop Information details

• All transport listed in the workshop Information details

• Sight-seeing and meals as listed in the workshop Information details

• The services of a Driver| Guide as described in the workshop Information details

• Airport transfers

• Bottled water for drinking during the workshop

• Park Entrance fees.

• Tips to all support personnel, including Guides, drivers…..

11. Exclusions

• international or domestic flights

• taxes and excess baggage charges

• meals other than those specified in the workshop Information details

• Visa, passport fees, and vaccination fees

• travel insurance

• Optional activities and all personal expenses

12. Exclusion and Limitation of Liability

1. We do not exclude or limit liability for our negligence or negligence omission which causes you personal injury or death.

2. We will not accept liability for any loss of or damage to photographic or any other equipment no matter how caused during or as a consequence of the services we provide.

3. It is your responsibility to ensure that you have adequate insurance to cover loss or damage to photographic or any other equipment before participating in the services.

4. In circumstances where we may be liable for any loss or damage suffered by you which is a reasonably foreseeable consequence of a breach by us of this Agreement, our maximum liability will be the amount of payment received from you for this particular service.

13. Age & Health requirements

Minimum Age: A minimum age of 16 applies. This is required by & for the Gorilla trekking

Maximum Age: This workshop can be physically demanding and you must ensure that you are suitably fit to allow full participation. We are able to provide details on mandatory health requirements; however, we are not medical experts. It is your responsibility to ensure that you obtain proper and detailed medical advice prior to travel for this adventure.

14. Travel insurance

Travel insurance is mandatory for all our workshop participants and should be taken out at the time of booking. Your travel insurance must provide cover against personal accident, death, medical expenses and emergency repatriation with a recommended minimum coverage of US$200,000 for each of the categories of cover. We also strongly recommend it covers cancellation, curtailment, personal liability and loss of luggage and personal effects. You must provide your travel insurance policy number and the insurance company’s 24-hour emergency contact number prior to the first day of your workshop; you will not be able to join the workshop without these details

15. Flexibility

You appreciate and acknowledge that the nature of this type of travel requires considerable flexibility and you should allow for flexibility. The itinerary provided for each workshop is representative of the types of activities contemplated, but it is understood that the route, schedules, itineraries, amenities and mode of transport may be subject to alteration without prior notice due to local circumstances or events.

16. Authority on workshop

Our workshops are run by a SnapAdventures leader. The decision of SnapAdventures leader is final on all matters likely to affect the safety or well-being of any traveler or staff member participating in the workshop. If you fail to comply with a decision made by a group leader or interfere with the well-being or mobility of the group, SnapAdventure may direct you to leave the workshop immediately, with no right of refund.

17. Acceptance of risk

You acknowledge that the nature of the workshop is adventurous and participation involves a degree of personal risk. You will be visiting places where the political, cultural and geographical attributes present dangers and physical challenges greater than those present in our daily lives. It is also your own responsibility to acquaint yourself with all relevant travel information and the nature of your itinerary. You acknowledge that your decision to travel is made in light of consideration of this information and you accept that you are aware of the personal risks’ attendant upon such travel.

18. Limitation of liability

We contract with a network of companies, government agencies and individuals to assist in the running of our workshops as agent for these third parties. We are not responsible for the acts and omissions of these third parties.

To the fullest extent permitted by law:

– any liability for any loss, death, injury or damage which you may suffer (directly or indirectly) in connection with or arising out of your participation in a workshop, or any breach of the Booking Conditions, is excluded;

– you release us and our officers, employees, agents and representatives from any liability and expressly waive any claims you may have against us arising out of or in connection with your participation in a workshop; and

– any condition or warranty which would otherwise be implied by law into these Booking Conditions (Implied Warranty), is excluded.

To the extent an Implied Warranty cannot be excluded, our liability in respect of the Implied Warranty is limited to (in our absolute discretion):

1. the provision of a similar workshop to an equivalent value; or

2. a refund of the total amount received by us from you in connection with your booking. Any claim by you is excluded to the extent that it is for indirect or consequential loss, loss of profits or economic loss, however it arises, or for indirect, special, punitive or exemplary damages.

19. Optional activities

Optional activities not included in the workshop price do not form part of the workshop or this contract. You accept that any assistance given by SnapAdventures or local representative in arranging optional activities does not render us liable for them in any way. The contract for the provision of that activity will be between you and the activity provider.

20. Claims & complaints

If you have a complaint about your workshop please inform your group leader or our local representative at the time in order that they can attempt to rectify the matter. If satisfaction is not reached through these means then any further complaint should be put in writing to us within 30 days of the end of the workshop.

21. Photos and marketing

You consent to us using images of you taken during the workshop for advertising and promotional purposes in any medium we choose. You grant us a perpetual, royalty-free, worldwide, irrevocable license to use such images for publicity and promotional purposes.

22. Privacy policy

Any personal information that we collect about you may be used for any purpose associated with the operation of a workshop or to send you marketing material in relation to our events and special offers. The information may be disclosed to our agents, service providers or other suppliers to enable us to operate the workshop.

23. Entire Agreement

These Terms and Conditions of Business constitute the entire Agreement between us and you and shall apply to all services provided by us. The invalidity or un-enforceability of any particular term of this Agreement shall not affect the other provisions herein.

24. Law and Jurisdiction

This Agreement shall be governed and construed by the Law of USA and you and we agree to submit to the jurisdiction of the Courts of USA.
